1. ABOUT THESE TERMS
These terms form the agreement between you and Haleem Rush for orders placed directly through our website or otherwise accepted by us. By submitting an order, you confirm that you are legally capable of entering into this agreement and that the information you provide is accurate.
Email: contact@haleemrush.co.uk. Service area: Aylesbury and surrounding areas.
Before launch: insert the proprietor’s legal name and full business postal address here.
2. PRODUCTS, PHOTOGRAPHS AND ALLERGENS
We prepare food in small batches. Photographs are illustrative; natural variations in colour, texture, portion presentation and garnishes may occur. Availability may change and we may withdraw a product or substitute a garnish only where this does not materially alter the order or its allergen information.
Allergen information must be reviewed before ordering. Contact us before placing an order if anyone eating the food has an allergy or intolerance. Although we take reasonable precautions, our kitchen handles multiple ingredients and we cannot promise an allergen-free environment unless explicitly confirmed in writing. Customers remain responsible for deciding whether a product is suitable for them based on the information provided.
3. ORDERS, ACCEPTANCE, PRICES AND PAYMENT
Adding items to a basket or submitting an enquiry does not mean an order has been accepted. A direct order is accepted when we send an acceptance or order-confirmation message. We may reject or cancel an order because of availability, capacity, delivery location, suspected fraud, payment failure or an obvious pricing error. If we cancel after payment, we will refund the relevant amount.
Prices and delivery charges are shown before checkout and are charged in pounds sterling. Payment must clear before fulfilment unless we expressly agree otherwise. Promotional offers cannot be exchanged for cash and may have separate conditions.
4. DELIVERY
We currently aim to deliver within approximately 5 miles of Aylesbury, generally from 6pm. Availability, fees and estimated times are confirmed during ordering. Delivery times are estimates unless we expressly agree a guaranteed time.
You must provide an accurate address, postcode, telephone number and any access instructions. Someone must be available to receive the order. If we cannot safely deliver after reasonable attempts to contact you, the order may be returned or disposed of and a refund may not be available. See our Delivery Policy.
5. NAAN, ADVANCE ORDERS AND CATERING
Naan is sold only as an accompaniment to haleem. Standard naan and homemade naan cannot be ordered on their own and must be ordered together with at least one haleem. There is no minimum naan order. Homemade naan is made fresh to order and requires at least 8 hours’ notice: orders that include homemade naan must be placed by 10am for same-day delivery, otherwise the earliest delivery date is the next day. If an order containing naan is placed without haleem, we may cancel it and refund it in full.
Large-order and catering enquiries normally start from 15 portions. A quotation is not a confirmed booking until we accept it and any required payment or deposit has cleared. The accepted quotation may specify final numbers, delivery arrangements, amendment deadlines and cancellation charges. Those agreed details form part of these terms.
6. DELIVEROO AND UBER EATS
Orders placed through Deliveroo, Uber Eats or another marketplace are also governed by that platform’s customer terms, pricing, privacy policy, refund process and delivery availability. Payment or delivery issues for those orders should normally be raised through the platform first.
7. CANCELLATIONS AND REFUNDS
Freshly prepared food is perishable. Change-of-mind cancellation rights that apply to many online goods may not apply once food preparation or committed purchasing has begun. This does not affect your statutory rights if food is faulty, unsafe, materially misdescribed or not supplied as agreed. Our detailed rules are in the Refund & Cancellation Policy.
8. PROBLEMS WITH AN ORDER
Contact us as soon as reasonably possible with your order number, a description of the problem and photographs where useful. Do not consume food you reasonably believe is unsafe. We may offer a replacement, partial refund, full refund or another appropriate remedy after reviewing the circumstances.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights. Subject to those rights, we are not responsible for losses that were not reasonably foreseeable or for business losses arising from a consumer order.
9. WEBSITE, EVENTS OUTSIDE OUR CONTROL AND LAW
Haleem Rush branding, original text and site design may not be copied for commercial use without permission. We are not responsible for delay caused by events reasonably outside our control, but we will contact you and take reasonable steps to minimise disruption.
If one provision is unenforceable, the remaining provisions continue. These terms are governed by the laws of England and Wales, and applicable UK consumer rights remain available. We may update these terms prospectively; the version in force when an order is accepted applies to that order.
